Before any athlete participates in a Three Peaks Performance INDIVIDUAL AT THE O’CONNELL SHOP we ask that you please fill out and sign the liability waiver

Waiver of Liability

I ______________________________________, as the parent and/or legal guardian of the participant stated above, have given my daughter/son permission to participate in the Three Peaks Performance Basketball Clinics/Individuals at the O’Connell House Shop, and I certify that he/she is in good health and can take part in all clinic activities. I fully understand that participation in the Three Peaks Performance Basketball Clinics/Individuals may involve serious risks and danger that may result in harm, bodily injury and death. While particular rules, equipment, and personal discipline may reduce the risk, I acknowledge the risk of serious injury does exist.

In the event of an emergency or an injury occurs, I authorize the clinic staff members to take all proper action and use the emergency service available at the nearest hospital if necessary. I understand my personal insurance will be used in this case.

I, for myself and on behalf of the participant hereby release and hold harmless against any claims, damages, and expenses Three Peaks Performance, the O’Connell family and any of their directors, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of the premises used to conduct the event.

In consideration for providing my child the opportunity to participate in sports and any related activity (such as clinic, practice, game, etc.), both my child and I voluntarily agree to waive and discharge any and all claims against Three Peaks Performance and the O’Connell family and release it from liability for any exposure to or illness or injury from an infectious disease including COVID-19.  This includes any claims for any negligent actions of Three Peaks Performance or its coaches to the fullest extent allowed by law.

I agree, for myself and on behalf of the participant to hereby release and hold harmless Three Peaks Performance, the O’Connell family, and any of their directors, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of the premises used to conduct the event against any liability, claims, causes of actions, demands (including attorney fees, fines, fees or other costs), damages and expenses or other costs (i.e. medical costs) arising out of any exposure to injury, illness or harm (including COVID-19) which may result from or in connection with my child's participation in sports or activities.

I acknowledge and agree that Three Peaks Performance retains the right to use photographs and videos taken of the event participants for publicity and advertising purposes.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENTS.
